Please Read Carefully By accessing or using OurSplit ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to all terms, do not use the Platform.

1 About OurSplit

OurSplit ("Company," "we," "us," or "our") is an online platform that provides AI-facilitated facilitation tools, document generation, and case management services to individuals navigating separation or separation proceedings. OurSplit is operated by Common Ground Mediating.

These Terms of Service ("Terms") govern your access to and use of the OurSplit platform, website, mobile applications, and all associated services (collectively, the "Service").

2 Eligibility

To use OurSplit, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable law
  • Provide accurate, complete, and current registration information

By using OurSplit, you represent and warrant that you meet all eligibility requirements.

Important Legal Notice OurSplit is NOT a law firm and does NOT provide legal advice, legal representation, or legal services of any kind. The Platform is a technology and communication tool only. Nothing on OurSplit โ€” including documents generated, AI facilitator statements, suggested agreements, or any other content โ€” constitutes legal advice or creates an legal professional-client relationship.

You are strongly encouraged to consult with a licensed legal professional in your jurisdiction before signing any agreement generated or facilitated through OurSplit. OurSplit expressly disclaims all liability arising from any reliance on Platform content as legal advice.

OurSplit's AI Facilitator is an artificial intelligence tool. It is not a licensed facilitator, legal professional, therapist, counselor, or mental health professional. AI-generated suggestions are provided for informational and facilitation purposes only.

4 User Accounts & Case Codes

When you create an account, you are responsible for maintaining the confidentiality of your login credentials. You agree to notify OurSplit immediately at [email protected] if you suspect unauthorized access to your account.

Each case is assigned a unique Case Code. By sharing your Case Code with another party, you are granting them access to the shared portions of your case. You are solely responsible for who you share your Case Code with.

OurSplit reserves the right to terminate accounts that violate these Terms, engage in fraudulent activity, or are used to harass, threaten, or harm other users.

5 Payments & Refunds

OurSplit offers paid plans processed through Stripe, Inc. By purchasing a plan, you agree to pay all applicable fees at the time of purchase. All prices are in USD.

Refund Policy

All sales are final. OurSplit does not offer refunds on any plan or purchase. By completing a purchase, you acknowledge and agree that no refunds will be issued under any circumstances.

Plan Upgrades

Users on the AI Guided plan ($299) may upgrade to AI + Facilitator Support ($699) at any time by paying the $400 difference. Case data is preserved upon upgrade.

6 Intellectual Property

All Platform content, features, and functionality โ€” including but not limited to software, text, graphics, logos, and AI models โ€” are owned by OurSplit or its licensors and are protected by intellectual property laws.

Documents generated through the Platform (including agreement drafts and parenting plans) are based on information you provide. You retain ownership of the underlying information you input. OurSplit retains the right to use anonymized, aggregated data to improve the Platform.

You may not copy, modify, distribute, or create derivative works from Platform content without our express written consent.

7 Limitation of Liability

Limitation of Liability To the maximum extent permitted by applicable law, OurSplit, its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising from your use of or inability to use the Service โ€” including damages related to the outcome of any legal proceedings, facilitation, or agreements โ€” even if OurSplit has been advised of the possibility of such damages.

OurSplit's total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to OurSplit in the twelve (12) months preceding the claim.

8 Indemnification

You agree to defend, indemnify, and hold harmless OurSplit and its affiliates from and against any claims, liabilities, damages, losses, and expenses โ€” including reasonable legal professionals' fees โ€” arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content you submit to the Platform.

9 Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court โ€” except that either party may pursue claims in small claims court.

Class Action Waiver: You agree that any arbitration shall be conducted solely on an individual basis and not as a class, consolidated, or representative action.

These Terms are governed by the laws of the State of California without regard to conflict of law provisions.

10 Termination

OurSplit may terminate or suspend your account at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive.

11 Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date and, where appropriate, sending an email notification. Continued use of the Service after changes constitutes acceptance of the revised Terms.

Privacy Policy

Our Commitment OurSplit handles some of the most sensitive personal information people share โ€” separation, finances, children, and family. We take that responsibility seriously. We will never sell your data. Period.

1 Information We Collect

Information You Provide Directly

  • Account information: Full name, email address, password (hashed)
  • Case information: Asset descriptions and values, debt information, parenting preferences, parenting plan details
  • Communications: Messages sent through the Platform between parties and the AI Facilitator
  • Documents: Files you upload to the Platform
  • Payment information: Processed entirely by Stripe. OurSplit never stores card numbers, CVV codes, or full payment details

Information Collected Automatically

  • IP address, browser type, operating system
  • Pages visited, time spent, features used (anonymized analytics)
  • Session tokens and authentication data

2 How We Use Your Information

We use your information solely to:

  • Provide, maintain, and improve the OurSplit Service
  • Generate documents, summaries, and agreements based on your inputs
  • Power the AI Facilitator with relevant case context (see AI Disclosure Agreement)
  • Process payments through Stripe
  • Send transactional emails (account verification, receipts, password resets)
  • Respond to support requests
  • Detect and prevent fraud and abuse
  • Comply with legal obligations

We do not: sell your data, share it with advertisers, use it for marketing to third parties, or use it for any purpose not listed above.

3 Data Sharing & Third Parties

Supabase (Infrastructure)
Database, authentication, and file storage. Data is encrypted at rest and in transit. Supabase is SOC 2 compliant.
Stripe (Payments)
Payment processing. Stripe is PCI DSS Level 1 certified. OurSplit never receives or stores raw card data.
Anthropic (AI Processing)
AI Facilitator functionality. Messages sent to the AI Facilitator are processed by Anthropic's Claude API. Anthropic's API data is not used to train models per their enterprise API terms.
Email Service Provider
Transactional email delivery only (account notifications, receipts).

We do not share your personal information with any other third parties except as required by law or with your explicit consent.

4 Data Between Parties

OurSplit is designed so that neither party in a case can access the other's private notes, private messages to the facilitator, or account settings. Only information explicitly shared in the joint case (shared asset list, joint messages, agreement drafts) is visible to both parties.

The AI Facilitator receives context from your case to generate relevant responses. This context is used in real time and is subject to Anthropic's API data handling practices.

5 Data Retention

We retain your account and case data for as long as your account is active and for up to three (3) years after account deletion, in order to comply with legal obligations and resolve disputes. You may request earlier deletion (see Section 7).

Payment records are retained for seven (7) years as required by financial regulations.

6 Security

We implement industry-standard security measures including TLS encryption in transit, AES-256 encryption at rest, row-level security on the database, and secure authentication via Supabase. See our Data Security Statement for full details.

7 Your Rights

Depending on your location, you may have the following rights:

  • Access: Request a copy of the personal data we hold about you
  • Correction: Request correction of inaccurate data
  • Deletion: Request deletion of your personal data ("right to be forgotten")
  • Portability: Request your data in a machine-readable format
  • Objection: Object to certain processing of your data
  • Opt-out of sale: We do not sell data, but you may formally request confirmation

To exercise any of these rights, email [email protected] with the subject line "Privacy Request." We will respond within 30 days.

8 Children's Privacy

OurSplit is intended for use by adults (18+) only. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, contact us immediately and we will delete it.

Information about minor children provided in parenting planning tools is used solely to facilitate the parenting plan and is subject to the same protections as all other case data.

9 California Privacy Rights (CCPA)

California residents have additional rights under the California Consumer Privacy Act. We do not sell personal information. California residents may request: (1) disclosure of data collected; (2) deletion of data; (3) opt-out of any future sale (we don't sell, but you may request confirmation). Contact us to exercise these rights.

10 Changes to This Policy

We may update this Privacy Policy periodically. We will notify you of material changes via email or a prominent notice on the Platform. Your continued use of the Service after the effective date constitutes acceptance of the updated policy.

Facilitation Participation Agreement

Agreement to Mediate By accessing the OurSplit facilitation platform, each participating party agrees to the terms of this Facilitation Participation Agreement. This agreement is entered into voluntarily by all parties to a case.

1 Nature of OurSplit Facilitation

OurSplit provides technology-facilitated facilitation assistance โ€” a structured process designed to help parties in separation or separation proceedings communicate, negotiate, and reach mutually acceptable agreements. This process is:

  • Voluntary: No party is required to reach any particular agreement
  • Self-determined: All decisions are made by the parties themselves, not by OurSplit or its AI
  • Non-binding until signed: Discussions and drafts are not legally binding until a Agreement Agreement is executed by both parties and, where required, approved by a court
  • Not a court proceeding: Participation does not constitute legal representation or substitute for court processes

2 Role of OurSplit

OurSplit and its AI Facilitator serve as a neutral facilitation tool. OurSplit does not:

  • Represent either party
  • Provide legal advice to either party
  • Make binding decisions on behalf of either party
  • Guarantee any particular outcome
  • Verify the accuracy of information provided by either party

For AI + Facilitator Support plan users, a human facilitator may be assigned to your case. Human facilitators on OurSplit are independent contractors. Their involvement does not create an legal professional-client relationship and does not constitute legal advice.

3 Confidentiality

All communications made through OurSplit in connection with facilitation are confidential, subject to the following:

  • Private notes and private facilitator messages are not shared with the other party
  • Joint session communications are visible to both parties and the assigned facilitator (if applicable)
  • Agreement documents generated through the Platform may be used in subsequent legal proceedings if executed by both parties
  • OurSplit may disclose information if required by law, court order, or to prevent imminent harm
  • Confidentiality does not apply to threats of violence, child abuse, or other mandatory reporting situations
Mandatory Reporting Exception OurSplit and any assigned human facilitators are required by law to report certain disclosures, including but not limited to: child abuse or neglect, elder abuse, and imminent threats of harm to self or others. Participation in facilitation does not exempt such disclosures from mandatory reporting requirements.

4 Party Responsibilities

Each party to a case agrees to:

  • Participate in good faith and with the intent to reach a fair resolution
  • Provide accurate and complete information about assets, debts, income, and other relevant matters
  • Treat the other party and the AI Facilitator with respect
  • Not make threats, engage in harassment, or attempt to intimidate the other party
  • Not provide false or misleading information for the purpose of obtaining an unfair advantage
  • Not use the Platform to facilitate fraud, asset concealment, or other illegal activity
  • Seek independent legal counsel before signing any final agreement

5 Voluntary Withdrawal

Either party may withdraw from the facilitation process at any time by ceasing to use the Platform. Withdrawal does not affect any rights the withdrawing party may have in legal proceedings, and Fees paid are non-refundable.

6 Finalization of Agreements

Agreements reached through OurSplit are not legally binding until:

  1. Both parties have reviewed the full agreement document
  2. Both parties have had the opportunity to seek independent legal counsel
  3. Both parties have signed the agreement (electronically or in writing)
  4. Where required, the agreement has been submitted to and approved by the appropriate court

OurSplit strongly recommends that all agreement agreements be reviewed by independent licensed legal professionals before execution.

7 Limitation of OurSplit's Responsibility

OurSplit is not responsible for: (a) the fairness or enforceability of any agreement reached through the Platform; (b) the accuracy of information provided by either party; (c) the outcome of any legal proceedings; (d) any harm arising from agreements that were not reviewed by an legal professional; or (e) any failure by either party to comply with a reached agreement.

You Are Interacting With an AI The OurSplit Facilitator is an artificial intelligence system. It is not a human facilitator, legal professional, therapist, or counselor. By using the AI Facilitator feature, you acknowledge and accept the disclosures in this document.

1 What the AI Facilitator Is

The OurSplit AI Facilitator is a conversational AI system powered by Anthropic's Claude language model. It is designed to:

  • Guide parties through a structured facilitation process
  • Ask clarifying questions to understand each party's interests and priorities
  • Suggest potential solutions and compromises based on information provided
  • Help parties communicate more effectively and constructively
  • Generate draft language for agreement documents based on agreed terms

2 What the AI Facilitator Is Not

Critical Limitations The AI Facilitator is NOT: a licensed facilitator, legal professional, legal advisor, therapist, mental health counselor, financial advisor, or any other licensed professional. Responses from the AI Facilitator do not constitute professional advice of any kind.
  • The AI Facilitator cannot verify the accuracy of information you provide
  • The AI Facilitator cannot guarantee that suggestions are legally sound or enforceable in your jurisdiction
  • The AI Facilitator cannot replace the judgment of a licensed legal professional or human facilitator
  • The AI Facilitator may make errors โ€” it is a language model and can produce incorrect, incomplete, or misleading information
  • The AI Facilitator does not remember conversations between separate sessions unless context is provided
  • The AI Facilitator is not neutral in the way humans are โ€” its responses are shaped by its training data and the instructions we provide

3 How the AI Processes Your Information

When you send a message to the AI Facilitator, OurSplit transmits the following information to Anthropic's Claude API:

  • Your message text
  • Relevant case context (asset list, children's names, parenting preferences, facilitation stage) โ€” in anonymized/summarized form
  • The current conversation history for that session

This information is processed by Anthropic to generate a response. Per Anthropic's API terms for enterprise customers, API data is not used to train Anthropic's models. See Anthropic's privacy policy at anthropic.com/privacy for full details.

4 AI Accuracy & Hallucinations

Large language models, including Claude, can produce responses that are factually incorrect, legally inaccurate, or contextually inappropriate โ€” a phenomenon sometimes called "hallucination." While we have designed the AI Facilitator with careful instructions to minimize this, we cannot guarantee that all AI-generated content is accurate.

You should:

  • Treat AI suggestions as a starting point for discussion, not a final determination
  • Verify any legal statements or standards cited by the AI with a licensed legal professional
  • Not sign or submit any agreement based solely on AI-generated content without professional review

5 Emotional & Mental Health Considerations

Separation and separation are among the most emotionally difficult experiences a person can face. The AI Facilitator is not equipped to provide emotional support, crisis intervention, or mental health services. If you are experiencing significant emotional distress, we encourage you to seek support from a licensed therapist or counselor.

If at any point you or anyone involved expresses an intent to harm themselves or others, please contact emergency services (911) or the National Crisis Hotline (988) immediately. The AI Facilitator is not able to provide crisis support.

6 Bias & Fairness

OurSplit has designed the AI Facilitator to be neutral and to not favor either party. However, AI systems can exhibit biases rooted in their training data. If you believe the AI Facilitator is consistently favoring the other party or making biased suggestions, please contact us at [email protected] so we can investigate and improve the system.

7 Human Facilitator Option

Users on the AI + Facilitator Support plan ($699) are assigned a licensed human facilitator in addition to the AI. Human facilitators are certified professionals. However, their participation through OurSplit does not constitute legal representation, and the same limitations regarding legal advice apply.

8 Acknowledgment

By using the AI Facilitator feature, you acknowledge that:

  • You understand you are interacting with an AI system, not a human
  • AI-generated content is not legal advice
  • You will seek independent legal counsel before executing any agreement
  • OurSplit is not liable for decisions made based on AI Facilitator output

Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs how you may and may not use the OurSplit platform. Violations may result in immediate account suspension or termination.

1 Permitted Uses

OurSplit is intended solely for:

  • Individuals navigating separation, separation, or dissolution of domestic partnership proceedings
  • Facilitating good-faith negotiation between separating parties
  • Organizing and documenting case information (assets, parenting arrangements, agreements)
  • Communicating with your partner in the case, assigned facilitator, and the AI Facilitator
  • Generating draft legal documents for professional review

2 Prohibited Conduct

You may not use OurSplit to:

Harm, Harassment, or Abuse

  • Threaten, harass, intimidate, stalk, or abuse any other user
  • Use the Platform to facilitate domestic violence, coercive control, or emotional abuse
  • Attempt to psychologically manipulate the other party through the Platform
  • Use the AI Facilitator to generate harassing or threatening content directed at any person

Fraud & Misrepresentation

  • Provide materially false information about assets, income, debts, or other case facts
  • Conceal assets or income for the purpose of obtaining an unfair agreement
  • Impersonate another person, including your partner, to gain unauthorized access
  • Create multiple accounts to circumvent restrictions or payment requirements

Illegal Activity

  • Use the Platform to facilitate money laundering, tax evasion, or financial fraud
  • Violate any applicable local, state, federal, or international law or regulation
  • Use the Platform in connection with any criminal enterprise

Platform Integrity

  • Attempt to reverse engineer, decompile, or extract the source code of the Platform
  • Attempt to access another user's account without authorization
  • Introduce malware, viruses, or other malicious code
  • Use automated bots, scrapers, or scripts to access the Platform
  • Circumvent any security or access control measures
  • Attempt to overload or disrupt Platform infrastructure (denial-of-service attacks)

AI Misuse

  • Attempt to "jailbreak" or manipulate the AI Facilitator into providing harmful, illegal, or deceptive content
  • Use AI-generated content to deceive the other party or a court
  • Submit fabricated case information to manipulate AI suggestions

3 Content Standards

All content submitted to OurSplit โ€” including messages, documents, and case information โ€” must not:

  • Be defamatory, obscene, or threatening
  • Violate the privacy rights of any person, including minor children
  • Infringe any intellectual property right
  • Contain sexually explicit material
  • Constitute hate speech or discrimination based on protected characteristics

4 Reporting Violations

If you believe another user is violating this AUP โ€” particularly in cases of harassment, threats, or abuse โ€” please report it immediately to [email protected]. Include your case number, a description of the violation, and any relevant screenshots or message excerpts.

In cases involving credible threats of violence or imminent harm, please contact law enforcement (911) first, then notify us.

5 Consequences of Violations

Violations of this AUP may result in:

  • Immediate suspension or termination of your account
  • Forfeiture of any paid plan fees
  • Referral to law enforcement where required or appropriate
  • Civil legal action by OurSplit or the affected party

OurSplit reserves the right to preserve and disclose account information and communications to law enforcement or courts in connection with violations of this AUP.

Our Security Commitment OurSplit is built on enterprise-grade infrastructure specifically chosen for its security and compliance credentials. We understand that the data on our platform is among the most sensitive personal information our users will ever share.

1 Infrastructure & Hosting

Database & Authentication โ€” Supabase
Built on PostgreSQL with row-level security (RLS) policies that ensure each user can only access data they are authorized to see. Supabase is SOC 2 Type 2 compliant and hosted on AWS infrastructure.
Payment Processing โ€” Stripe
All payment data is handled exclusively by Stripe, which is PCI DSS Level 1 certified โ€” the highest level of payment security certification. OurSplit never stores, transmits, or processes raw card data.
AI Processing โ€” Anthropic Claude API
